Вы правы. Вот здесь знающий человек (представитель США в комиссии НАТО по Восточной Европе) говорит, что байка об уставе НАТО и территориальных спорах - это миф:

Many people have mistakenly repeated the claim that Russia's seizure of territory means Ukraine cannot join NATO. As one blogger put it, "NATO is prohibited by its own charter from accepting new members who have ‘territorial disputes'."

In reality, NATO's charter -- the North Atlantic Treaty -- makes no prohibition on any country joining. In one of its more rhetorical paragraphs, it declares itself open to admitting "any other European State in a position to further the principles of this Treaty and to contribute to the security of the North Atlantic area" (Article 10). This is neither a prohibition nor an authorization, since no authorization is needed for a group to unanimously accept a new member; it is simply an encouragement, to get certain countries to think about joining.


Более того, вторжение России в Украину резко изменило шанс последней на присоединение к НАТО: от практически невозможного то высоко вероятного.

Russia's invasion has changed the odds on NATO membership for Ukraine from virtually impossible to highly probable. It has also meant that it will be consummated on a basis far more anti-Russian than was ever imagined before.
